IVA Register – What You Need to Know

Individual Voluntary Arrangements (IVAs) are on the increase. Over the course of 2018, 71,000 debtors chose this form of debt solution to finally claw their way out of financial trouble. If you’re exploring your options, a key deciding factor in your next step may be about how the IVA Register could impact your life. So let’s find out…

What is an IVA Register UK?

The IVA register UK includes the database of people who have gone bankrupt. Let’s begin by clearing something up. The IVA Register only applies to those in Northern Ireland. However, it is an often-used term when people mean to refer to the Insolvency Register.

When a person uses an insolvency debt solution in England or Wales, they are added to the Individual Insolvency Register ; insolvency debt solutions include bankruptcy, Individual Voluntary Arrangements and Debt Relief Orders.

In Scotland, they are added to the Register of Insolvencies, while in Northern Ireland they are added to the IVA Register.

Can Other People Find Out About My name in the IVA register?

If you’re considering using an IVA as a debt solution, you may be wondering whether other people can find out about you in the IVA database. Let’s answer this question in no uncertain terms: yes, those you know could access the IVA Register. IVA register is free to use and search online. However, it’s unlikely that anyone – including your friends and family – would search IVA register. Primarily IVA register is for the purpose of creditors, landlords and employers.

The Insolvency Service is obliged by law to maintain the register, so there is a transparent and accessible record of individuals who are insolvent.

IVA Register UK – What Details are Recorded?

When you enter an IVA the IVA Register databse will hold various details, including:

  • Your name
  • Your last known address
  • Your date of birth
  • Your gender
  • The date the IVA was approved
  • The practitioner who is supervising the IVA

These details will remain on the IVA Register for three months following the IVA being completed, revoked or terminated.

To complete an IVA, you must make all the payments required and abide by the IVA terms. Should you not fulfil your obligations, the IVA may be terminated. In this case, you’d be in the same position as when you entered the IVA, and would no longer be protected from your creditors. The revoking of an IVA only happens when the original decision to approve it is reversed. This may happen if the courts find that you have misled them in some way.

IVA Register UK – How is the IVA Register Accessed?

IVA Register can be accessed online for free. All that is needed is the name or trading name of the person. The IVA Register can alternatively be searched in person at an official receiver’s office.

IVA Register is not something to be concerned about. It exists simply to provide information to those who are affected by debtors who have entered into an IVA.
